Muy utilizadas en derecho procesal / Very
common in litigation:
- Iura novit curia = el juez conoce el derecho = the court knows the law
- Da mihi factum, dabo tibi ius = dame los hechos y yo te daré la ley = give me the facts and I shall give you the law
- Conditio (o/or condicio) sine qua non = condición necesaria = indispensable condition
- Fumus boni iuris = presunción de buen derecho = presumption of sufficient legal basis
- Periculum in mora = peligro por retraso = danger due to delay
Derecho de los contratos / Contractual:
- Pacta sunt servanda = los contratos deben cumplirse = agreements must be kept
- Rebus sic stantibus = estando así las cosas = matters standing thus
